GENERAL POWER OF

 ATTORNEY

 

 

          KNOW ALL MEN AND BY THESE PRESENTS that I,______________ Muslim, adult, ------------------ holding NIC No.----------------,do hereby ordain, appoint, nominate and constitute __________________Muslim, adult, resident of NIC No.___________ as my  and lawful attorney in respect of my  property----------and to do the following acts and deeds.

 

1.           To sell, gift, transfer, convey , mortgage, exchange, charge , lease out or otherwise dispose of  the abovesaid

property   to    any  person  or persons at such price and/or  on such

terms  which  my said attorney in his absolute discretion may deem fit and proper.

2.           To sign the sale agreement, conveyance deed, rent  agreements, rent out the said property or any part thereof on fixed term or on a monthly or other periodical tenancy or occupation on such terms as he may deem fit and to recover the rent.

 

3.           To receive the payment and to issue valid receipts and discharge in respect thereof and to make payments for taxes, repairs and other charges or dues and all other expenditure whatsoever and to obtain receipts for such payments.

 

4.           To appear and prosecute any  civil /criminal matter  in any Court or make, swear and file plaint, succession petition and letters of  Administration, rent application, suit, appeal, petition or application written statement, verify  the pleadings, objections, memorandum of appeal before District Courts, High Courts, Supreme Court or any other Court, judicial or quasi judicial authority for  the admission, denial or execution of any document or to file appear and prosecute any cause or causes  before any Court or authority, any bank or Coop. Society, Collector or Commissioner of Income Tax, Wealth Tax, Tax Authorities, Collector of Land Revenue and any other assessing authority, Municipal Authorities, Police Officer, Govt. Semi Govt. Local, self Govt. Dept. or officers, their authorities and  also officers of the Bank, insurance Companies, House Building Finance Corpn. Capital Gain Tax, Excise and Taxation, KMC, KBCA, KESC, KDA, Local District City Govt for me and on my behalf.

 

5.           To appear before the competent authority/Registrar-Sub-Registrar for the execution and registration of  Sale Deed, Redemption Deed, Gift Deed, Relinquishment Deed, Release Deed or any other Deed and to present documents before the  KBCA, City Government, Corporation, Govt/ Semi- Govt. District & City Govt.or any other authority and receive documents from the said offices and to record  statement and complete all such formalities as may be required in connection with  the said property.

 

6.           To approve and to present for approval to all the relevant authorities including KBCA and District  & City Government, the plans  of proposed construction and modifications and alterations, completions thereto and to  obtain approval and sanction to the relevant authorities for the same.

 

7.           To give evidence or cause  the evidence to be given ,  summon  witnesses and records and produce records in connection with the said property.

 

8.           To appoint and engage lawyers, Advocate, Solicitors in connection with the said cases for me and on my behalf.

 

9.           To appoint or nominate sub-attorneys and to give them all or any of the powers mentioned hereinabove and to revoke the powers given to the sub-attorneys as appointed.

 

10.       Generally to do all acts, deeds and things and matters, pertaining and in connection with and/or attaching the said property or any portion thereof.

 

11.       This  General Power of Attorney  is irrevocable and shall be binding on me and my successors, heirs and assigns, in all respects until it is revoked by Joint written consent on myself and my said attorney.

 

AND I do hereby agree that all acts , deeds and things done by my said attorney shall be construed as acts, deeds and things done by me undertake to ratify  and confirm all and whatsoever that the said Attorney shall do or cause to be done by virtue of the powers hereby given.
