DEBTS AND SECURITIES BELONGING TO DECEASED

SHAKILA HYDER WIFE OF GHULAM HYDER (LATE)

PETITION  UNDER SECTION 278 OF THE

SUCCESSION ACT,  1925

 

The petitioner respectfully  submits as under:-

1.       That Petitioner’s Mother Shakila Hyder was a Govt teacher died  at Karachi on 14.02.2010. He was  Sunni Muslim.

Death Certificate is annexed and marked          Annexure-A .

 

2.       that petitioner’s Father Ghulam Hyder also died at Karachi on 06-07-2011.

          Death Certificate is annexed and marked                             Annexure-B .

 

3.       That the deceased was domiciled in and was permanent resident of Karachi . The said deceased at  the time of her death left behind immovable properties  mentioned in the schedule.

 

3.       That  the deceased died intestate and due and diligent search was made for a will but none was found.

 

4.       That the deceased left behind the following legal heirs according to Muslim Law:-

5.  That  the Petitioner claims to be entitled to the properties mentioned in the schedule which  were likely to come in the hands of the legal heirs of the deceased and has filed this petition.

 

6.  That  the petitioner has  truly setforth  in the schedule  the properties which the said deceased possessed and /or was entitled to at the time of her death/or which have or are likely to come to the  legal heirs of the deceased.

 

7.  That the deceased at the time of death was residing  within the jurisdiction of this Hon’ble Court.

 

8.       That appropriate Court fee is paid.

          The Petitioner, therefore respectfully prays that this Hon’ble Court may be pleased to grant Letters of Administration in favour of the Petitioner in respect of the property mentioned in the schedule alongwith the dividends & necessary  accretions with all attending powers and benefits.
